My name is Carole Helton I am at this time fighting to get visitation with my 2 greatsons. NM CYFD will not connect me with the worer I need to talk to. I am told to call back in an hour then try again later, then try again before 5:00. Finally at 5:00 I am told to call back first thing in the morning. 3 minutes after 8:00 I call to be told she has already left. This goes on nd on. All I want is a visit with them when my granddaughter sees them for a birthday. This has been one excuse after another for the last 6 weeks. No one tells the family anything at all. I am the one guilty of talking to the school and starting this mess. If any onr ever asks me about CYFD I personally will tell them to take care of the matter themselvs. You cannot trust these people. I also have been told they get a bonus for each child they enter into the system. I also believe they keep these children past the proper time for state monies. Join the national organization, Govabuse.org. We just had a national rally August 12th and it went well. The more the merrier. I am up in Washington State fighting hard for families. I need tremendoushelp. Cyfd has my 2 very young children. They put one in a treatment center that taught my 7 yrold about gangs and put him on drugs without notifying CYFD or the foster parents. With his first visit the center coordinator told us that she would let some of the rules slide since it was our first visit and let us bring food and clothes to him. The only thing he hoped we brought him was some underwear-this is odd. The following week we tried to get another visit with him. The center said we couldnt, we were breaking the rules and had to get our case managers approval. The case manager said we had to get the centers approval. We finally got another visit 2 weeks later for 1 hour. he asked us to get him some food he was hungry. We told him we couldnt, it would break the rules. Again they done us the same way before getting another visit, saying we tried to sneek something in to him and we didn't. 2 weeks later we finally got another visit. My 7 year old son broke down crying saying "I love and miss you to. I want to come home. I dont want to be here. It took everything in me not to break down to. We finally got him calmed down. THERE ARE NO CAMERAS.They cancelled our visits and communication with him. We faught hard to get at least a phone call. It took 2 and a half months he tried to be strong and started to cry saying he thought we abandoned him. We told him we miss him, love him and pray for him every day and to be strong follow the rules we will see him soon. We told him if he has any problems to tell his therapist. We also said we won't give up on him. No one even told him why the visits were stopped. CYFD said we made sufficent progress and started transition. The following week we had a 1 hour physical visit and the house manager kept talking to my husband about how the rules were going to change now and that he suggested our son to be home before school starts so he wont have to adjust to another school. This was our time to visit him not to talk to someone else.When it came time to leave my son started crying badly, saying please dont leave me here daddy. He had to calm him down and told him to be strong. The following week we were allowed anotlher phone call. He sounded much better and confident talking about coming home. Then he said he was happy because he gets off the drugs tomorrow. We asked him. Are you on medicine? Then our caseworker said oh I'll tell you about it after thephone call. She didnt think he would tell us. He said the foster parents came to say goodbye and that his little sister could not come because she had a visit with us. This made him think his sister was at home and he couldnt be. He asked when can I come home? We told him that is up to your therapist. Then she said that is up to your case worker. It was during this goodbye visit that the foster parents found out he was put on drugs. After the phone call we asked our case worker why they put him on drugs. She said because he was crying all the time and not sleeping at night. We had unsupervised visits with my daughter for about 3 months and up to 2 days before the next court. While returning her to the foster father after our last visit, which was 2 days before court, she kept saying momma daddy back home momma daddy back home?, pointing back towards our house. During this court, which was the last one, when transition-custody return was suppose to happen, again CYFD said we werent following the rules.The treatment coordinator lied and said he was showing extreme bad behavior, that we were breaking rules and that he did not say he felt abandoned.There are no cameras to video what goes on. The CASA report said he was hurting himself and that he is afraid of cameras. This is untrue, because he use to play on thecomputer and video himself and jump in front of the camera when I took pictures.He told the examiner that he took pictures of himself and put them on the computer. The idea of him hurting himself is puzzling, because he is suppose to have one on one supervision. A search warrant was issued because they thought we were doing somethinglllegal on the computers. Our lawyer was suppose to present that cameras be placed where he is so no one could lie. However, our lawyer didn't. The judge believed my husband was lying and stopped all communication and transition. My sons birthday was 3 days before the next hearing. Our lawyer and caseworker were suppose to get back with us to let us know if it got approved to send him a card. No one would return calls. So my husband went a head and sent him a card. This is 2 birthdays we missed. The caseworker said we were breaking the rules and that I was being disrespectful to the people at my counseling place when I wasnt, telling the judge that I told them I quit my job and needed to get CYFD to pay for my visits since they are making me go there. This is untrue. I am out on leave due to my high blood pressure and all the things I am going through affecting my heart. This confidential information should not have been discussed with my caseworker. When the judge asked my attorney if she had any questions for the caseworker, she said no. WHAT! My attorney just sat there and didn't represent us. She didn't ask questions,didn't subpoene witnesses and didn't present evidence. They all think we did something to our children when we didn't and the doctors' reports prove it. Based on the above and the fact that the computer information, that went through the local police department and the FBI without finding any substantial proof, isn't back from another agency, the judge approved to persue with ADOPTION. CASA,the guardian at litam and CYFD pushed for adoption. The CYFD got the judge to approve putting my son back on the drugs(an adult medication Seroquel 100mg-hes only about 40lbs.) because he was crying all night and NOT SLEEPING again there is no communication or visits since they are persueing adoption. We feel that because of the attachment between my 3yr old daughter and the foster parents, they are trying to adopt her. They abused my son. During one of our visits before he got sent to the treatment center, he did an out cry about the foster father tapping him real hard on the head with his fingers and fingernails causing bumps and sores. We checked him and he did have sores and bumps and he complained of it hurting. Our parenting coach witnessed his outcry. We turned it into the Sherrif and the police. Nothing was done and we were told that sky-an internal investigation- took care of it. The law states it has to be an outside agency to conduct the investigation. Right after the outcry they sent my son to a treatment center without notifying us.We feel my son was sent out of retaliation. The foster father said there was an incident at the boys and girls club with a police report. There was no such thing. CYFD used this as part of the reason to send him to the treatment center. At the end of the hearing CYFD told the judge that my son could be at this treatment center until he is 18. This is ridiculous. The foster family spoil my daughter and buy her fancy clothes and shoes and have her calling them mommy and daddy since they both went into foster care. The foster parents told my son the devil lives in our house and we are devils. They would ground my son 15 days to his room for doin something bad. One of the foster relatives was the investigating case worker and one was in charge of the family visitation center, where they were saying we were regressing and not using our parenting skills. Our current caseworker use to work at the same place as me and her mom and sister did too. Both her mom and sister tried to get me fired and removed from my position at work. We asked for a different caseworker and they won't change her. It took all the money we had to get the attorney we have. We just don't know how we can get another. Please can anyone help me? My precious gifts from GOD do not deserve this. If the adoption goes through, they may never know their real loving, admiring and caring parents. This is cruel and abusive conditions to prepare my children and us for their return and then not tell them anything while cutting off all bonds and ties to their biological parents.

Also I believe CYFD is abusing their power for funding to all the organizations helping them and for themselves. They get funding for all their issues and then use parents insurance as well. What is happening to all the money?

Just want to let all those confronted with the dishonest corrupted agency dont give up educate yourself learn the laws learn their guidelines and protocols i did and beat them with knowledge and learning your resources and stand up to them always stay one step ahead of them

Hello and thank you for inquiring on my case with cyfd. its been about a year and a half and we beat them. I had a strong lawsuit but not the funds to back it. Tony, I just stumbled on reading about CYFD employees abusing their authority and job positions. The abuse is rampant throughout New Mexico, I know those words are no consolation to you and offer no solutions. Today is May 2, 2011, CYFD employees are still acting like they are their own country, with attorneys that are lied to by the employees so that CYFD can always come out smelling like a rose. There is more than one way to take care of people who abuse the law, I do not have rock solid answers, but I have plenty of advise given to me by an attorney from California. CYFD employees are taking chances with endangering the lives of young children and CYFD employees making false accusations regarding responsible parents, proactive grandparents, and caring uncles and aunts. Word has gotten around about CYFD, they had better watch their p's and q's, because people who abuse the law and children will sooner or later have to answer for their wrong doing. CYFD employees are some of the most abusive people working in state government, pediphiles, junkies, functional alcoholics, phonies being paid at taxpayer's expense, there is only so much that people can take. my name is Anthony Zamora and currently going through a legal matter against cyfd in Alamogordo. I have contacted many government agencies and many political people, in regards to this matter. CYFD in Alamogordo has abused their authority, and conducted themselves in inappropriate, unproffessional manners. I will give you an idea of what ordeal I am faced with. July 10 of this year my children were taken from me and my family. It all started with a call that was placed on an odor emitting from the outside of the home. So in turn a local police officer and a CYFD employee were dispatched to the home. The mother was confronted by the two agencies and come to find out that the call was given to the wrong agency, it was supposed to go to code enforcement, well in turn the mother was disgruntled by this, and an argument engaged between the cyfd employee and the mother, well needless to say the cyfd employee scared my children so bad, that my 7 year old dialed 911 on her, she tried to have the mother arrested but the officer at the time had no grounds for an arrest. So they gave the mother an verbal warning to have the outside of the home cleaned up. Here's where abuse of their power is initiated. The cyfd employee is so irrate 9 and a half hours later she convinces an corrupt officer to engage in her plan. They obtain a warrant for her arrest and take my children into cyfd custody and to this day niether I nor my family cannot have our children. We have contacted many different agencies, and have talked to many different people affiliated with government agencies in regards to this matter. There have been many empty promises through cyfd, many hang ups, no call back the list goes on. They did not notify me or any family members until 5 days after the incident, they know they are at fault and have tried substantiating their allegations by lies and slander. I need to know who the right people to contact while this goes on I get scheduled visits one hour a week to hear my children cry and tell me how afraid they are of cyfd employees, my children have never been abused they are all healthy and what gets me is that i visited my children and found my youngest with an ear infection and asked the adoptive parents to why he has that ear problem she told my that cyfd, out of spite, cancelled their insurance and now they cannot go to the doctor. The mother is sitting in jail on 3rd dgree child abuse charges for a stain on the carpet and a stain on the counter. The state knows they cannot convict her on such charges so are right now, trying to settle for a misdomenor. I need some help can you assist me? My home number is 5754372187 Anthony Zamora

It is obvious the CYFD doesn't really care about family, they violated Phillips rights through the FMLA. Everyone who saw this happening and stood back and did nothing should be held accountable. Phillip has fought for our country, our rights, should'nt we fight for his? I say YES! Phillip needs to know that he has supporters out here, we need to stand together and assist this Serviceman and his Family.

How sad that this article still has not been published in the Gallup Independent or the Gallup Herald. Seems like somebody doesn't want the Mckinley County area people to pick up on this sad situation that has happened to Phillip and his family. This is not how a place of employment should treat their servicemen and their employees. I am surprised the TV news stations have not picked up on this. I pray for Phillip and his family see justice within our laws that will prohibit this from happening to anyone else. CYFD DEFENDENTS YOU SHOULD BE ASHAMED OF YOURSELFS FOR TREATING GOOD PEOPLE LIKE THIS.

Thank you for writing this - there is so little labor news in NM Media.
State officials always throw out a phrase like "department officials do not comment on pending litigation of personnel matters."
They are only hiding their own wrongdoing.
Obviously the employee, Mr Ramirez, has been going public on this (Bravo for you!, Phil) and it is the employee who decides (not the employer) if such issues can be made public. See the AFSCME contract Article 17, Section 2.
